Regulations for the Registration and Parking of Motor Vehicles

(Applicable both to students and to staff who are hereby notified that all vehicles parked on University land are parked there at their owners' risk.)

  1. The University is an independent institution incorporated under Royal Charter and is empowered under that Charter to make Regulations and to do all such acts and things as may be requisite to further the objects of the University as a place of education and learning. The University's premises are inadequate to provide for all vehicles which staff students and visitors might wish to bring to the University and the University Council has approved the following Regulations in order to ensure orderly and in so far as it may be possible equitable use of vehicles allowed under licence whether real or implied to enter the University's premises.

Definitions

  1. The following terms shall have the meanings specified:-
'Premises' means any land or buildings in University ownership or under the control of the University including land or buildings occupied by private individuals or companies whether as tenants or licensees.
'Land' means any ground owned or controlled by the University whether open space, car parks, roads, footpaths or covered by buildings of any kind.
"Halls of Residence" means University premises (other than private houses) provided for the accommodation of students and staff whether or not board is also provided (including Bassett House but excluding Clarkson House, Shaftesbury Avenue, Tasmin Court at Ocean Village and Erasmus Park at Winchester).
"Sports grounds" means those lands at Wide Lane and at Stoneham Lane together with the Boat Hard at Monks Brook which are in University ownership and are used by staff or students.
'Staff' means any or all employees of the University of Southampton; employees of University lessees; employees of the Natural Environment Research Council at Southampton Oceanography Centre; and employees of the Southampton City Council at New College whether working full-time or part-time.
'Students' means any or all students registered for courses of study in the University whether on a full-time or part-time basis. Students will not be entitled to claim other parking rights due, for example, to secondary employment since their primary purpose for attending the University defines their status as students.
'Contractor' means any person or firm that contracts to supply materials, labour or a service to the University and includes any firm or person sub-contracted to do so.
"Visitor" means anyone other than staff or students with a bona fide reason for visiting the University but not any contractor or employee of a company based on the University's academic sites where the employee or company has agreed to abide by these Regulations. Without affecting the generality of the foregoing but for the avoidance of doubt "visitor" covers any member of the University as defined in Statutes Section 2 other than staff and students and retired staff who are receiving remuneration from the University.
'Disabled' means any student, member of staff or visitor who for the purpose of these Regulations is acknowledged by the University to have particular transport difficulty by reason of infirmity or physical disability.
'Motor vehicle' means a mechanically or electrically propelled vehicle with two or more wheels but not a pedal cycle unless an engine of any kind has been fitted thereto.
'Motor car' means a mechanically or electrically propelled vehicle with three or more wheels but not a pedal tricycle unless an engine of any kind has been fitted thereto.
'City boundaries' means the boundaries of the local government area administered by the Southampton City Council.
'Permit' means a document issued by the Estates and Buildings Department for the authorised parking of a motor vehicle.
'Relevant' means appropriate for the site and valid for the time when used.
  1. These Regulations shall except where otherwise expressly stated apply to staff students and visitors. These Regulations apply to all the University's premises except where expressly stated that they apply only to specified locations.

  2. These Regulations are made by Council which has delegated authority to the University Management Group to vary or extend the Regulations applicable to all University managed sites and set fees as appropriate. Notwithstanding the foregoing no addition shall be made to these Regulations which would permit the attachment of wheel clamps or other obstacles to the unimpeded progress of a motor vehicle without the express consent of Council.

  3. Students enrolled for the first year of an undergraduate course shall not bring a motor car within the City boundaries unless one or more of the following circumstances is applicable:
(a) a student whose home address is within the City boundaries and who has notified that address to the University when registering for his/her course.
(b) a student whose home address is outside the City boundaries and whose term-time address is also outside the boundaries provided that the term-time address has been notified to the University when registering for his/her course.
(c) a student who is disabled.
(d) a student who occupies accommodation at a Hall of Residence or who has firmly accepted a place at a Hall of Residence and who has been issued with an official parking permit by the Hall Authorities for use at that Hall only.
(e) a student who has an exceptional situation in his/her personal circumstances.
  1. Any student having the use of a motor vehicle and who is not precluded by Regulation 5 from bringing it within the City boundaries shall provide details of that vehicle at the time of registration for his/her course except that such a student acquiring the use of a motor vehicle subsequent to registration must notify the Chief Security Officer within seven days of acquiring the vehicle.

  2. All users of vehicles and pedal cycles on University premises shall comply with traffic signs and notices which may be displayed either permanently or from time to time and with instructions from uniformed Security Staff and other employees having requisite authority.

  3. Any infringement of these Regulations may lead to disciplinary or other steps being taken by the University against any member of staff or student concerned.

  4. Continuous parking of vehicles between 23.00 hours and 06.00 hours, is only allowed on academic sites where express permission has been given by the Chief Security Officer.

  5. Two-wheeled vehicles do not require parking permits but shall be parked only in the parking areas designated for such vehicles.

  6. Motor cycles motor scooters and mopeds shall not be driven along any road or in any car park on the Highfield Site other than for the express purpose of parking in an area designated for parking such vehicles and then only by the shortest route possible from the public highway.

  7. No member of staff and no student has a right to bring a vehicle to any part of the premises covered by these Regulations unless he or she has been licensed to do so by means of a parking permit.*

  8. Motor cars belonging to members of staff or to students may be parked on University premises provided that a relevant car parking permit is prominently displayed* on the front windscreen of the vehicle and there is sufficient space in the designated parking areas for vehicles to be properly parked. It shall be an offence against the Regulations not to display the Permit. Vehicles shall be parked only in spaces designated for such purpose and each vehicle shall occupy no more than one parking space unless approval has been granted by the Chief Security Officer.

  9. Holders of parking permits other than the designated office holders shall not park vehicles in spaces reserved and marked for the use of official vehicles and/or designated office holders and for such temporary purposes as may from time to time be decided by the Director of Estates and Buildings nor shall they park in areas where access is reserved and restricted to particular categories of permit holders such as holders of entry cards to barrier-controlled car parks and the Pay and Display Car Park.

  10. Holders of parking permits other than disabled drivers shall not park vehicles in spaces reserved and marked for the use of disabled persons.

  11. Holders of parking permits shall not park vehicles in spaces reserved by bollards or those marked for the use of visitors or taxis.

  12. Holders of parking permits who contravene these Regulations shall be guilty of a disciplinary offence. A member of staff or a student not holding a valid parking permit but who in contravention of these Regulations brings a motor vehicle on to these premises shall also be guilty of a disciplinary offence. Offenders against these Regulations may be fined by the University in such sum or sums within maxima authorised by the University Management Group from time to time. Fines shall be paid within twenty working days from the date of the fine being issued by the Chief Security Officer.
    There will be a period of ten working days after the issue of the ticket during which the driver may appeal against the fine. The grounds for appeal will be clearly stated on the ticket. Such grounds will allow appeals to be made if the facts relating to the infringements can be demonstrated to be materially incorrect or inaccurate or if exceptional circumstances were prevailing at the time of the infringement. If no appeal is made, after ten working days, the fine must be paid within twenty working days from the date of the fine.
    Appeals against fines, which satisfy the grounds for appeal, will be considered by the Chief Security Officer. He will have the power to waive the fine, reduce the level of a fine, or confirm a fine. In the event that the appellant is dissatisfied with the outcome then a further appeal may be made to the Director of Estates and Buildings. If it is decided that a fine is to be paid, the procedures outlined above will be applied for ensuring its payment. For the avoidance of doubt, the University shall have the authority to recover from an offender any legal or administrative costs incurred by the University in connection with his or her offence in addition to, or instead of, any fine imposed under this Regulation.
    Holders of parking permits who park vehicles in spaces reserved and marked for the use of disabled persons may have their permits summarily withdrawn at the discretion of the Director of Estates and Buildings. In such circumstances a pro-rata reimbursement of the charge made for the permit is claimable.
    Persons who forge, alter or copy an authorised permit and display the same or who use an unauthorised permit for an unauthorised purpose may be subject to disciplinary action.

  13. In the event of an offender being a member of staff and within the prescribed period failing to pay a fine properly imposed or to reimburse the University's expenses that sum or sums shall be deducted from a monthly salary or weekly wages payment as appropriate, the timing of such deduction to be a matter within the discretion of the Secretary and Registrar for the time being.

  14. In the event of an offender being a student and failing to pay a fine properly imposed or to reimburse the University's expenses within the time specified for such payment then the University shall treat the sum or sums so involved as any other debt to the University thereby preventing the student obtaining any University qualification whatsoever until such time as the debt is discharged in accordance with the provisions of Ordinances.

  15. Visitors to the University shall park their vehicles in spaces designated for the purpose** but no visitor has a legal right to park on University academic sites and shall not do so if designated space is unavailable.

  16. Visitors contravening these Regulations shall if possible be warned and their attention drawn to these Regulations.

  17. Wheel clamps and/or adhesive notices may be affixed to any vehicle parked in disregard of these Regulations and a charge shall be made for the removal of any wheel clamps so affixed. The maximum charge to be made shall be authorised by the University Management Group from time to time.

  18. Nothing in the foregoing Regulations shall in any way inhibit or restrict the University initiating proceedings in the courts whether against a member of staff or a student or a visitor if in the discretion of the Secretary and Registrar for the time being the nature of the offence or the series of offences is such as to justify that course of action.

  19. These Regulations are contained in the Calendar on the University's Web Site. Such publicity shall be given to these Regulations as may be decided from time to time by the Director of Estates and Buildings or his nominee. Copies of the Regulations shall form part of any application forms for the issue of a parking permit and applicants shall be required whether a permit is issued or not to sign an undertaking to abide by and observe each and every requirement here set forth.

  20. Applications for parking permits shall be made in a manner and at a time specified each year by the Director of Estates and Buildings. Students and members of staff shall normally submit their applications to the Chief Security Officer. The criteria on which parking permit are allocated shall be decided from time to time by the Director of Estates and Buildings. Most staff permits will be valid until 28 February but otherwise permits will be valid until the day preceding the next academic session. The permits will be printed to indicate the period of validity.

  21. Student permits will not allow parking at Boldrewood or Winchester School of Art unless exceptional circumstances prevail.

* The requirement that vehicles belonging to staff or students must have a valid parking permit on academic sites remains in force throughout the year including vacations, but is waived at weekends and from 18.00 hours (16.00 hours at Avenue Campus and New College) to 24.00 hours on Monday to Friday evenings in term time.

** The requirement that visitors shall park their vehicles only in spaces designated for visitors' use on academic sites is waived at weekends from 18.00 hours (16.00 hours at Avenue Campus and New College) to 24.00 hours on Monday to Friday evenings in term time.

Use and Parking of Bicycles

(Applicable both to students and to staff who are hereby notified that all bicycles parked on University land are parked there at their owners' risk.)
  1. Cyclists are required to observe and to comply with the regulations concerning the movement of traffic on the University sites, including those relating to the one-way system on the Main Site.

  2. Cycling on footpaths and grassed areas on the University sites is prohibited.

  3. Bicycles do not require parking permits.

  4. Whenever possible, bicycles should be parked in designated areas where clips, stands or other facilities are provided - under no circumstances may bicycles be taken into buildings or parked where they are liable to cause obstruction, e.g. near ramps for use by disabled people or at entrances to buildings.

  5. Bicycles which are found in buildings or parked where they are liable to cause obstruction may be removed or impounded. Security chains and other devices will be cut if necessary. A charge shall be made for the recovery of an impounded bicycle. The maximum charge shall be authorised by the Estates Planning Sub-Committee from time to time.

  6. Cases of non-compliance with the above regulations may result in offenders being brought before the Secretary and Registrar who will take appropriate action.
